On July 9, President Biden issued an executive order encouraging the Federal Trade Commission to ban or at least limit the use of non-competes, even by private corporations. Biden’s rationale is that “in over 75% of U.S. industries, a smaller number of large companies control more of the business than they did twenty years ago.” He is concerned that barriers to competition suppress wages and drive up the prices consumers pay for goods and services, reporting that this costs the average U.S. household $5,000 a year.
