The Department of Labor (DOL) recently announced that it would increase Family and Medical Leave Act (“FMLA”) and wage and hour audits of employers. These audits may be triggered by employee complaints, initiated randomly, or conducted as part of a targeted enforcement initiative.

You must prepare for the DOL to review your FMLA policies and practices, including recordkeeping, eligibility determinations, and notification procedures. Examiners can even interview employees to gather information about their experiences with your organization’s FMLA policies.

If the DOL finds a violation, it can require your organization to take corrective action, such as reinstating a wrongfully terminated employee or providing back pay for lost wages. The Department may also impose fines and penalties.
