Training Overview

Affirmative Action at your company - Discover the current legal landscape and make changes.

President Joe Biden recently completed his first 100 days in office. He issued more than 50 executive orders during this time, including ensuring and expanding employee rights under Title VII of the 1964 Civil Rights Act.

Last June, in the Bostock decision, a healthy Supreme Court majority ruled that “sex” under Title VII includes sexual preference and sexual orientation. The Court also concluded that an affirmative action admissions program at the University of Texas satisfied the due process and equal protection clauses of the 14th Amendment.

The Department of Labor’s Office of Federal Contract Compliance Programs aims to tighten its oversight of the Affirmative Action Plans required of recipients of federal funds, including higher education institutions.

You need to understand these changes and update your company’s affirmative action policies and practices to comply.
